Terms of Service

These Terms govern your access to and use of the AgeVerify EU API, developer dashboard, and related services provided by [COMPANY LEGAL NAME] ("AgeVerify EU", "we", "us"). By creating an account or using the Services you agree to these Terms. If you are accepting on behalf of a company or other legal entity you represent that you have authority to bind that entity.

1. Definitions

"Services" means the AgeVerify EU age verification API, hosted verification UI, developer dashboard, sandbox environment, webhooks, and any related software or documentation.

"Customer" or "you" means the company or individual that registers an account and accepts these Terms.

"End User" means a natural person whose age eligibility is verified through the Services on behalf of the Customer.

"Verification Session" means a single initiated age verification request associated with one End User.

"API Key" means a secret credential issued to a Customer App used to authenticate API requests.

2. Account Registration

To use the Services you must create an account, provide accurate organization and billing information, and designate an authorized signatory. You are responsible for maintaining the security of your API Keys and dashboard credentials. Notify us immediately at legal@ageverifyeu.com if you suspect unauthorized access.

One account may contain multiple organizations. Each organization is subject to independent KYB (Know Your Business) review before live mode access is granted.

3. Service Description

AgeVerify EU provides an age verification API that allows Customer platforms to confirm whether an End User meets a configurable age threshold. The Services route verification requests to integrated wallet providers (EUDI Wallet, France Identité, and other national eID schemes) and return a boolean age eligibility result via webhook or polling. No names, passport images, or exact dates of birth are stored in the production database.

The sandbox environment uses simulated providers for development and testing and does not process real identity credentials.

4. Permitted Use

You may use the Services solely to:

  • Verify the age eligibility of End Users for lawful age-restricted products or services;
  • Test and develop integrations in the sandbox environment;
  • Manage your organization, apps, API keys, webhooks, and billing through the developer dashboard.

You must comply with all applicable laws, including GDPR, the EU Age Verification Blueprint, and sector-specific age verification regulations in the jurisdictions where you operate.

5. Prohibited Use

You must not:

  • Use the Services for any unlawful purpose or in violation of any regulation;
  • Resell, sublicense, or white-label the Services without a separate written reseller agreement;
  • Reverse engineer, decompile, or attempt to extract source code;
  • Use live API keys on platforms where KYB has not been approved;
  • Circumvent rate limits, quotas, or billing controls;
  • Use the Services to build a competing age verification product or API;
  • Process verification results to infer or store additional personal data beyond the boolean age eligibility outcome.

6. Subscription Plans and Billing

The sandbox plan is provided free of charge for testing purposes. Production (live mode) access requires a paid subscription plan. Pricing is published at ageverifyeu.com/pricing and managed via Stripe in your dashboard.

Billing is calculated on successful verification completions (billable checks). Cancelled, failed, or expired sessions are not billable. Monthly invoices are issued to the billing email on your organization account.

You may configure hard monthly quotas in the dashboard. If quotas are disabled, overages are charged at the per-check rate for your plan. We reserve the right to suspend live API access if invoices remain unpaid after 15 days.

EU VAT rules apply. B2B customers with a valid EU VAT number receive reverse-charge invoices. B2C customers pay VAT at the rate applicable in their EU member state.

7. KYB Review and Live Mode

Before your organization may use live production API keys you must complete our Know Your Business (KYB) review. This requires submitting your legal company name, registered address, VAT number or company registration number, business sector, and a description of your age verification use case.

We review submissions within 3–5 business days and may request additional documentation. Live mode approval may be revoked if submitted information is found to be materially inaccurate or if your use case changes in a way that violates these Terms.

8. Acceptable Age Verification Practices

Customers are responsible for ensuring that age verification is applied at legally required points in their user flow (e.g., before checkout, on first login to age-restricted content). AgeVerify EU provides a verification result; determining whether to permit or deny access based on that result is solely the Customer's responsibility.

You must not use verification results for any purpose other than confirming age eligibility for the specific transaction or session for which the verification was initiated.

9. Intellectual Property

AgeVerify EU and its licensors retain all right, title, and interest in the Services, including all underlying software, algorithms, branding, and documentation. These Terms grant you a limited, non-exclusive, non-transferable right to use the Services during the subscription term.

You retain ownership of your organization data. By using the Services you grant us a limited licence to process your data solely to provide and improve the Services as described in our Data Processing Agreement.

10. Confidentiality

Each party agrees to keep confidential all non-public information of the other party that is designated as confidential or that a reasonable person would understand to be confidential given the nature of the information and circumstances of disclosure. API Keys and signing secrets are considered confidential information of AgeVerify EU. Confidentiality obligations do not apply to information that is publicly available, independently developed, or required to be disclosed by law.

11. Uptime and Support

We target 99.9% monthly uptime for the production API. Planned maintenance will be communicated with at least 24 hours' notice via the status page at status.ageverifyeu.com. Sandbox availability is provided on a best-effort basis.

Support is provided via email at support@ageverifyeu.com. Enterprise customers may have separate SLAs as agreed in writing.

12. Warranties and Disclaimers

We warrant that the Services will perform materially in accordance with the documentation under normal use. To the maximum extent permitted by applicable law, all other warranties — express, implied, or statutory — including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, are excluded.

Age verification is a probabilistic process dependent on the accuracy of identity credentials and providers. AgeVerify EU does not warrant that every verification will correctly identify an End User's age, and is not liable for regulatory non-compliance arising from reliance on verification results.

13. Limitation of Liability

To the maximum extent permitted by law, neither party shall be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or business, arising out of or in connection with the Services, even if advised of the possibility of such damages.

AgeVerify EU's aggregate liability for direct damages arising under or in connection with these Terms shall not exceed the total fees paid by you in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless AgeVerify EU and its officers, directors, employees, and agents from and against any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of: (a) your use of the Services in violation of these Terms; (b) your violation of any applicable law or third-party right; or (c) your platform's failure to obtain required regulatory approvals for age-gated content or commerce.

15. Term and Termination

These Terms remain in effect while you maintain an account. Either party may terminate with 30 days' written notice. We may suspend or terminate your account immediately if: (a) you materially breach these Terms and fail to cure within 10 days of notice; (b) your account is used for fraudulent or illegal activity; or (c) required by law.

On termination, your right to use the Services ceases immediately. Sections 9 (IP), 10 (Confidentiality), 12–14 (Warranties, Liability, Indemnification), and 16 (Governing Law) survive termination.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of Germany. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany, provided that either party may seek injunctive or other equitable relief in any jurisdiction.

EU consumer protection laws may provide additional rights to individual consumers in their country of residence that these Terms cannot limit.

17. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email and/or by posting a notice in the developer dashboard with at least 30 days' notice before the changes take effect. Continued use of the Services after the effective date constitutes acceptance of the revised Terms.
